Client Communication: Gag Clause Prohibition Compliance Attestation

Dear [Client],
If you had active coverage with Sanford Health Plan at any point between December 23, 2023, through November 1, 2024, Sanford Health Plan has submitted the Gag Clause Prohibition Compliance Attestation (GCPCA) on your behalf. 

If you had active coverage with another carrier at any point during that time frame, additional attestation may be required. You should contact the respective carrier to verify that they will be submitting the GCPCA on your behalf, or visit https://www.cms.gov/marketplace/about/oversight/other-insurance-protections/gag-clause-prohibition-compliance-attestation for instructions on how to submit the attestation on your own behalf. 

The first GCPCA was due in 2023, and subsequent attestations covering the period since the last preceding attestation are due by December 31st of each year thereafter. Sanford Health Plan will complete subsequent attestations on your behalf, as long as you have active coverage within the reporting period and have not opted to report on your own behalf.
