No Surprises Act

Sanford Health Plan is making changes to comply with the No Surprises Act, a new federal law that took effect on Jan. 1, 2022. The law is intended to provide consumers with transparency regarding health care costs.

As part of this law, agents and brokers who sell on-exchange or off-exchange individual, short term limited duration (STLD) and group plans are now required to disclose direct and indirect compensation received from enrolling members in such coverage.

To assist with compliance, Sanford Health Plan:

  • Has added the Model Compensation Disclosure Form to all Sanford Health Plan’s paper/downloadable application forms.
  • Has added a link to the Model Compensation Disclosure to the agent portal under the "Resources" tab.
  • Has included language to off-exchange applications, which contains a link to the Model Compensation Disclosure for use when quoting or selling off-exchange policies.
  • Will insert a copy with all welcome letters sent to on-exchange members upon enrollment or renewal.

The Group Disclosure Notice is being created now and will eventually be posted to the Agent Portal for your reference.
